In political science, one issue still in need of greater theorizing is the proper measurement of bureaucratic autonomy, that is, the degree of discretion that political principals should grant to bureaucratic agents. This article reviews the literature on bureaucratic autonomy both in US administrative law and in political science. It uses the American experience to define five mechanisms by which political principals grant and limit autonomy, then goes on to survey the comparative literature on other democratic systems using the American framework as a baseline. Other democracies use different mixtures of these mechanisms, for example by substituting stronger ex post review for ex ante procedures or using appointment and removal power in place of either. We find that the administrative law and social science literatures on this topic approach it very differently, and that each would profit from greater awareness of the other discipline.

Please join us in congratulating Didi Kuo, Center Fellow at the Freeman Spogli Institute for International Studies (FS), and co-author Andrew S. Kelly, Assistant Professor in the Department of Health Sciences at California State University, East Bay, on being awarded the 2023 Leonard S. Robins Award for the Best Paper on Health Politics and Policy by the American Political Science Association (APSA)!

The Robins Award is named in honor of Leonard S. Robins, who, through his presence and gentle questioning at virtually every health politics panel, graciously nurtured the scholarship of both junior and senior scholars. The award recognizes the best paper on any subject that fits under the rubric of Health Politics and Policy presented at the previous annual APSA meeting.

Kuo and Kelly's award-winning paper, "State Capacity and Public Health: California and COVID-19," investigates the comparative COVID-19 policy response across counties and regions within California. In the description of the 2022 APSA panel "The Politics of Pandemic Response and the Opportunities for Health Policy Reform," during which they presented their paper, it notes that "In moving beyond a consideration of formal state and public health capacity, Kuo and Kelly argue that the more robust policy response of the Bay Area was, in part, a product of partnerships between state and community-based actors. Drawing on the concept of 'embedded autonomy,' Kuo and Kelly reconceptualize public health capacity and consider it within broader issues of state capacity and democracy."

On March 17, 2020, six counties in the Bay Area jointly issued the nation’s first shelter-in-place orders in response to the COVID-19 crisis. Cities and states across the United States quickly followed suit, with varying degrees of success. Public health officials have been critical in setting policies, enforcing behavioral and non-pharmaceutical interventions, and communicating with the public. This paper explores the determinants of public health capacity, distinguishing between formal institutional capacity (ie budget, staff) and informal embedded capacity (ie community ties, insulation from political pressures). It argues that informal embedded capacity is critical to public health capacity, but difficult to measure empirically. It concludes by relating public health capacity to broader issues of state capacity and democracy.

Case Study: Gifford Pinchot and Sustainable Forest Management


The year was 1909, and Gifford Pinchot, Chief Forester of the United States, faced a terrible personal dilemma. He had discovered a pattern of corruption in the sale of public lands to developers and other private interests. But the new president, William Howard Taft, depended on support from western Republicans and had placed a gag order on the whole affair. Pinchot was outraged at this evidence of corruption reaching the White House, but he wanted to give Taft a fair hearing. The new president had, after all, vowed to support conservation and strong control over federal lands. Taft invited Pinchot to the White House, where he alternately implored Pinchot not to go public with the matter and threatened him with dismissal if he violated the gag order. Pinchot had in his pocket a letter that could expose the scandal. This case explores the dilemma of Pinchot, a mid-level bureaucrat dependent on a president’s good will, and the strategies available to him. It shows the power of a single leader and the similarities the United States once had with many developing nations struggling with widespread corruption.

Through this case, students will gain a better understanding of how good communication is important for persuading stakeholders that a reform objective is both achievable and beneficial.

California faces a host of difficult, long-term challenges in housing, transportation, water and climate, education, jobs and business, governance reform and other areas. Policy issues are complicated enough, but when one tries to think about them over the long-term, the considerations become even more complex. This project, California Considers: Policy Deliberations for our Long-term Success, will present detailed results on 56 proposed policy options, both in terms of conventional polling and in terms of what a representative sample of more than 700 California residents, gathered together virtually to deliberate in depth from all over the state, think about these policy choices. The result is a Deliberative Poll®, a poll before and after a representative sample deliberates in depth. A separate sample, a control group that did not deliberate answered the same questions in the same time period. Hence the result is an unprecedented experiment probing public opinion about the state’s many long-term challenges.

The Deliberative Poll® was conducted by the Stanford Deliberative Democracy Lab, DDL, (housed within the Center on Democracy, Development and the Rule of Law, part of the Freeman Spogli Institute for International Studies at Stanford University), in collaboration with the Goldman School of Public Policy at the University of California at Berkeley and the California 100 Initiative. DDL has been involved in more than 120 Deliberative Polls® in 50 countries around the world, but never to probe the public’s considered judgments about the policy challenges of the further future. The deliberations took place on the Stanford Online Deliberation Platform, an AI-assisted form of moderation designed in collaboration with the Crowdsourced Democracy Team at Stanford and its director Professor Ashish Goel of Management Science and Engineering. The deliberations in moderated small group discussions on video in groups of 10 took place over an entire weekend, or during the week, for periods of equivalent length.

Results


The deliberations took place over four sessions during either the weekend or weekday, in the months of February and March. Participants met in moderated small group discussions on video in groups of 10 for periods of equivalent length. After deliberation on the policy proposals, the 700 expressed their conclusions in confidential questions. After considering all the pros and cons, there was supermajority support for ensuring adequate funding for infrastructure for roads and digital broadband, for vouchers for low-income access to public transit, for incentives for the creation of affordable housing, and new support for K-12 education. There was also significantly increased support for reform of CEQA (California Environmental Quality Act) and for increasing the threshold by which the state constitution can be changed with an initiative (from majority support to a requirement of 60%). "This Deliberative Poll® allowed Californians from across the state to listen to each other and learn from each other's experiences. Participants found that even though they may live in different parts of the state, have different jobs, or different lifestyles, their opinions on many of the policy issues are not so different. And, that they share the same concerns and worries for the state," added Alice Siu, Associate Director of DDL.

“California Considers shows that Californians are worried, upset, and unsure about California’s future, but they also felt more hopeful, curious, and energized about the future following deliberations where they got a chance to make concrete proposals to solve California’s problems. There are many novel findings from this exercise that merit deeper exploration, to help California address its looming challenges,” said Henry Brady, Director of Research for California 100.

“The California Considers Deliberative Poll® presented a representative sample of over 700 Californians with policy ideas that could transform our state’s direction in the long-term,” said Karthick Ramakrishnan, executive director of California 100. “Rather than simply getting their initial perspectives and taking them at face value, participants read briefing materials, deliberated with each other and experts, then revisited their positions to see what they concludedafter becoming better informed. What we found is that, in many instances, Californians from different backgrounds coalesced around common ideas seen as helping our state become more transparent, efficient, and innovative.”

California Considers: Discussing Big, Bold Ideas for the State’s Future

A sample of Californians were asked to react to transformative policy reforms for the future. Hear what they had to say and what it could mean for you and our state.


California 100, in partnership with Stanford University’s Deliberative Democracy Lab (Stanford DDL) and the UC Berkeley Goldman School of Public Policy, embarked on an effort to ask Californians directly to react to big, bold policy proposals that could dramatically transform the state’s trajectory in the years and decades ahead.

Using previous deliberative polls conducted by Stanford DDL as inspiration, “California Considers: Policy Deliberations for Our Long Term Success” was designed to center the experiences and perspectives of real Californians from every walk of life to test how significant changes in policy might improve the quality of life for all residents. Participants were given a pre-survey, participated in deliberations with one another, then asked for their final opinions about various policy ideas. These results will be released in tandem with this discussion.

This Piece argues that Americans need to shed their anti-partyism and take a second look at parties: Political parties are the only civic associations with the capacity to organize at a scale that matters and the only intermediaries that both communicate with voters and govern. The Piece, however, advances a fundamentally different orientation to party reform—one that pushes beyond a view of parties as vehicles for funding elections, policy-demanders, or heuristic brands. Instead, it offers a conception of party strength that emphasizes political parties as organizations, and it offers a blueprint for party reform that emphasizes strengthening the organizational and associational features of political parties. Finally, the Piece offers strategies for associational party-building that do not depend on federal legislative intervention—or any legislative intervention. Throughout, it grounds the theoretical intervention in empirical evidence from recent trends in state and local party-building to show that associational party-building is a feasible direction for party reform. In sum, it explains why Americans need strong parties, how we should conceive of them, and how we might get there.

Last week, as the world marked one year since Russia’s invasion of Ukraine, former Ukrainian Prime Minister Oleksiy Honcharuk shared a message with Americans:

“It’s not a war for territories or resources. It’s not a regional conflict. It’s a war for freedom and democracy,” he said during a panel discussion Friday at the Bechtel Conference Center at Stanford University.

The public event was hosted by the Freeman Spogli Institute (FSI) and the Center on Democracy, Development, and the Rule of Law (CDDRL) to mark one year since Russia’s invasion of Ukraine. It took place before live and virtual audiences, including many wearing blue and yellow in support of the Ukrainian effort.

Honcharuk served as Ukraine’s 17th prime minister from 2019-2020, and in 2021, was the Bernard and Susan Liautaud Visiting Fellow at FSI. He was joined by Serhiy Leshchenko, a former journalist, member of Ukraine’s parliament (2014-2019), adviser to President Zelenksyy’s chief of staff, and a 2013 alumnus of the Draper Hills Summer Fellows program at the CDDRL; Oleksandra Matviichuk, founder of the Center for Civil Liberties and former visiting scholar with the Ukrainian Emerging Leaders Program at the CDDRL (2017-2018); and Oleksandra Ustinova, the People’s Deputy of Ukraine, a current member of Ukraine’s Parliament, and a former visiting scholar with the Ukrainian Emerging Leaders Program at the CDDRL (2018-2019).

Honcharuk, Leshchenko, and Ustinova attended virtually from Kyiv, while Matviichuk joined virtually from Paris, France. During the event, they discussed the impact of the war on daily life, the global democratic order, and Ukraine’s future. The discussion was moderated by Michael McFaul, director of FSI and a former U.S. ambassador to Russia, and ended with a brief Q&A session with audience members.

A New Reality


In his opening remarks, McFaul asked the panelists to share their mood as they enter the second year of the war. Ustinova said that just prior to the panel event, they’d been informed of an impending Russian attack.

“There is a very high probability that today, Kyiv and other cities will be shelled pretty heavily,” she said, adding that despite the threat, they weren’t going anywhere and that the parliament was still in session.

“That’s the mood of Ukrainians,” she said. “We know we can be hit any day, we can die any day, but this is the reality we have to live in.”

We all have to realize, this is not a Ukrainian war. If the West loses in Ukraine, it will be a total collapse for the rest of the world.

Honcharuk said he’d heard the opinion that authoritarian regimes are better suited for war because they are more mobile and less distracted by politics, thus creating the impression that democracies are indecisive. But, he said, Ukraine’s war effort demonstrates the opposite.

“I feel proud that Ukraine now denied this and showed the power of democracy,” he said.

When an audience member asked how the war has impacted political life in Ukraine, Honcharuk said there are challenges. For example, there are some conflicts between the central and local governments, but they don’t appear to be systemic problems. He said the parliament is still working and all Ukrainian political parties are “more or less united.” He also noted that President Volodymyr Zelenskyy has “huge support” from the Ukrainian people.

Aid and Allies


Since the start of the war, the United States has spent tens of billions of dollars on aid to Ukraine, including artillery, tanks, and rocket launchers. The support has not only helped Ukraine stave off defeat, but enabled their success in many battles against Putin’s army.

In a recent interview with Stanford News, Steven Pifer, a former U.S. ambassador to Ukraine and an affiliate at Stanford’s Center for International Security and Cooperation (CISAC), said that Ukraine’s military had considerable success in the last four months of 2022, pushing Russian forces out of the Kharkiv region and back across the Dnipro River in Kherson.

On Friday, the panelists expressed gratitude for the support of the United States and other western allies in aiding their victories on the battlefield.

“Thank you,” Matviichuk said. “Ukraine and Ukrainians will always remember how American people support us in [these] dramatic times.”

Honcharuk agreed and said he viewed the U.S. as a partner in the war. “I want American people to understand that now we are together – Ukraine on the frontline, you on the back,” he said.

The panelists also urged for continued cooperation from Western allies.

“The prescription for war is three [items],” Leshchenko said. “First is weapons, second is sanctions [on Russia], third is financial support.”
 

Looking Ahead


The group expressed hope that this year Ukraine will see a victorious end to the war. Leshchenko added that he would like to someday see Ukraine join the North American Treaty Organization (NATO) because it could make significant contributions to the alliance.

“I think the Ukrainian army [is] going to be the best army in Europe,” he said. “It would be a privilege for NATO to have the Ukrainian army’s support because it will defend Europe much better than Europe has [been] able to do with its own army.”

Ustinova said a common misunderstanding about the war is that it started last year with Russia’s invasion of Ukraine. But the conflict, she said, dates back to 2014 when Russia annexed the Crimean peninsula, and she explained how Ukrainians define success.

“Our victory is the total liberalization of each kilometer of the captured territories since 2014. Not since 2022,” she said.

She added that what’s most important to understand about the war is that it has broad implications, including for the West.

“We all have to realize, this is not a Ukrainian war,” she said. “If the West loses in Ukraine, it will be a total collapse for the rest of the world.”

The Role of Public Diplomacy in Democracy Promotion

In partnership with the Center on Democracy, Development and the Rule of Law, the U.S. Advisory Commission on Public Diplomacy is pleased to host a moderated panel discussion on the role of public diplomacy in democracy promotion at Stanford University.

A distinguished panel of experts, including Larry Diamond, Michael McFaul, and Kathryn Stoner, will discuss how USG public diplomacy programs can most effectively promote and defend democratic values in an increasingly authoritarian and illiberal global context.  The panel will also consider whether the U.S. is still a credible force in championing democracy around the globe. Finally, we hope this panel will yield insights into how public diplomacy programs can better shape the way foreign publics perceive and act upon their citizen rights and responsibilities.

Intended for an audience of public diplomacy practitioners, policymakers, scholars, and Stanford professors and students, this panel will also be of interest to think tanks, NGOs, and academic institutions and centers devoted to the study of the diplomacy/democracy nexus. Participants can join in person or online.
