Carolyn A. Mercado is a senior program officer with The Asia Foundation in the Philippines. In this position she manages the Law and Human Rights program. She assists in the development, implementation, monitoring, and evaluation of other selected activities within the Foundation's Law and Governance program and handles mediation and conflict management, and other forms of dispute resolution processes. She has also served as a temporary consultant to the Asian Development Bank on the Strengthening the Independence and Accountability of the Philippine Judiciary project and the Legal Literacy for Supporting Governance project.

Prior to joining the Foundation, Ms. Mercado was an intern with the Center of International Environmental Law in Washington. Previously, she served consultancies in Manila for the World Bank, the United Nations Development Programme, the International Maritime Organization, NOVIB, and the Philippines Department of Environment and Natural Resources. She has served as lecturer on environmental law at Ateneo de Manila University, San Sebastian College of Law, and the Development Academy of the Philippines. She also previously served as executive director of the Developmental Legal Assistance Center, corporate secretary of the Alternative Law Groups, and as a legal aide to a member of the Philippine Senate.

Education: B.A. in political science from the University of the Philippines; LL.B. from the University of the Philippines College of Law. She was also a Hubert Humphrey Fellow in international environmental law, University of Washington and a European Union Scholar in environmental resource management, Maastricht School of Business in the Netherlands.

Boris Begovic is president at the Center for Liberal-Democratic studies (CLDS) and professor of economics at the School of Law, University of Belgrade. He received his education at the University in Belgrade, London School of Economic and JFK School of Government, Harvard University. His field of expertise includes industrial organization, economic analysis of law, economic growth, economics of competition policy, and urban economics. Begovic was a chief economic adviser of the Federal Government of Yugoslavia (Serbia & Montenegro) 2000-2002, mainly involved in negotiations with IFIs, WTO accession and foreign trade liberalization, price liberalization and foreign debt rescheduling. Recent publications include: Corruption: An Economic Analysis (2007), Greenfield FDIs in Serbia (2008), Economics for Lawyers (2008) and From Poverty to Prosperity: Free Market Based Solutions (2008).

As democracy is based on one person - one vote rule and freedom of expression and it can bring a strong political pressure for compulsory redistribution, contrary to authoritarian political environment. Is there a systematic difference in redistributive and other economic policies between democracies and other countries? What are the effects of incentives created by democratic political decisions to the most productive segments to the society and economic growth they create? To what extent compulsory redistribution is violating protection of property rights and undermining sustainable economic growth? Do we have a consistent theory that can explain these relations? Is there any consistent empirical evidence? Are the consequences of democracy to the economic growth the same if the country came from the left wing or right wing authoritarian societies. These issues will be reviewed on the seminar.

Globalization creates lucrative opportunities for traffickers of drugs, dirty money, blood diamonds, weapons, and other contraband. Effective countermeasures require international collaboration, but what if some countries suffer while others profit from illicit trade? Only international institutions with strong compliance mechanisms can ensure that profiteers will not dodge their law enforcement responsibilities. However, the effectiveness of these institutions may also depend on their ability flexibly to adjust to fast-changing environments.

Combining international legal theory and transaction cost economics, this book develops a novel, comprehensive framework which reveals the factors that determine the optimal balance between institutional credibility and flexibility. The author tests this rational design
paradigm on four recent anti-trafficking efforts: narcotics, money laundering, conflict diamond, and small arms. She sheds light on the reasons why policymakers sometimes adopt suboptimal design solutions and unearths a nascent trend towards innovative forms of international cooperation which transcend the limitations of national sovereignty.

Nicholas Hope is the Director of the Stanford Center for International Development (SCID). He also directs SCID's China research program. His current research is private enterprise development in China and progress of reforms in China, especially in the financial sector. His interests are in East Asian economies, especially China and Indonesia, and his teaching interests are in development of Asian economies, role and effectiveness of international financial institutions, and thesis supervision of students working in those areas.

Prior to coming to Stanford, Dr. Hope worked at the World Bank as Country Director for China and Mongolia, and Director of the Resident Staff in Indonesia. He is the co-editor, with Dennis Tao Yang and Mu Yang Li, of How Far Across the River?: Chinese Policy Reform at the Millennium (Stanford University Press, 2003). He also co-edited, with Belton M. Fleisher, Anita Alves Pena, and Dennis Tao Yang, Policy Reform and Chinese Markets (Edward Elgar Publishing, 2008).

Dr. Hope received his Ph. D. from Princeton University, and his undergraduate degrees from Oxford University and the University of Tasmania. He was awarded the Tasmanian Rhodes Scholarship and a research fellowship from the Brookings Institution in Washington, D.C.

Jenny S. Martinez is the provost at Stanford University, formerly the Richard E. Lang Professor of Law and Dean of Stanford Law School and the law school’s 14th dean. Professor Martinez is a leading expert on international law and constitutional law, including comparative constitutional law. She is the author of The Slave Trade and the Origins of International Human Rights Law (Oxford University Press, 2012) and numerous articles in leading academic journals. She teaches courses on constitutional law, civil procedure, international law, and international business transactions. She is a Senior Fellow (by courtesy) of Stanford’s Freeman Spogli Institute for International Studies and a faculty affiliate of Stanford’s Center on International Security and Cooperation and Stanford’s Center on Democracy, Development and the Rule of Law.

An experienced litigator, she has worked on numerous cases involving international law and constitutional law issues. She served as a member of the U.S. State Department’s Advisory Committee on International Law. She is also a member of the American Law Institute.

Before joining the Stanford faculty in 2003, Professor Martinez clerked for Justice Stephen Breyer (BA ’59) of the U.S. Supreme Court and Judge Guido Calabresi of the U.S. Court of Appeals for the Second Circuit; she was also an associate legal officer for Judge Patricia Wald of the United Nations International Criminal Tribunal for the former Yugoslavia in The Hague, where she worked on trials involving genocide, crimes against humanity and war crimes.

With what now seem like almost weekly product scandals, recalls, and supply chain exposes, the public increasingly wants to know more about the products they are putting in, on, and around their families. Until recently, consumers had no way to find out the full impacts of the products they consumed. However, with advances in information technologies, product assessment methodologies, and web and mobile platforms, there is now a real potential to radically increase transparency in consumer markets and global supply chains. Dara O'Rourke, Associate Professor at UC Berkeley, will discuss an experiment in providing information to the public about the environmental, social, and health impacts of products and companies: GoodGuide. GoodGuide's award-winning web and iPhone apps have been featured recently in the New York Times, Newsweek, Time, and even Oprah's Magazine! Dara will discuss GoodGuide's long-term vision, current strategies, and the information technologies they are applying to this challenge.

Dara O’Rourke is an Associate Professor at the University of California, Berkeley, and the co-founder of GoodGuide. Dara’s research focuses on systems for monitoring the environmental, labor, and health impacts of global production systems. His research has been featured in The New York Times, The International Herald Tribune, The Boston Globe, The Los Angeles Times, The Economist, Business Week, Newsweek, Time, and TechCrunch. Dara has served as a consultant to international organizations such as the World Bank, the United Nations Development Programme, the Organization for Economic Cooperation and Development, and a wide range of domestic and international non-governmental organizations. He has degrees in Mechanical Engineering, Political Science, and Energy and Resources, and he previously taught at MIT.

GoodGuide seeks to revolutionize how consumers see and interact with products and companies. GoodGuide provides a suite of tools that offer information about the environmental, social, and health performance of products and companies to consumers at the point of purchase (through web and mobile apps), and that empower people to screen and compare products based on their personal values and concerns. GoodGuide's tools seek to empower millions of consumers to buy products that better match their values, to avoid products that are detrimental to their health, the environment, or issues they care about, and to participate in a more transparent marketplace.

The stated purpose of the Trade Act of 1974 was to promote free trade. Section 301 authorized the U.S. President to impose retaliatory trade sanctions if negotiations were unsuccessful in reducing unreasonable limits on trade. The Act was reinforced in 1984, became known as “Super 301”, and made annual assessment and retaliatory measures mandatory.

Because of trade imbalances, four emerging Asian countries gave the US firms access to cigarette markets: Japan (1987), Taiwan (1987), South Korea (1989) and Thailand (1990). These forced market opennings were called the “Second Opium War” by local protestors in these countries, challenging U.S. export of unwelcome and unhealthy products.

A sea change occurred in the decades that followed the cigarette market opening in Taiwan. Of particular interest are changes in areas marketing skills and market share; lower cigarette prices; paradoxical increased smuggling; increased youth consumption; evolution of the powerful tobacco industry lobby; and a sharp increase in tobacco-related cancer deaths. Accompanying the increased cigarette consumption, a special, unusual habit of chewing betel quid started and grew into a mainstream practice among adult males (nearly one out of four). Oral and esophageal cancer increased sharply soon after the market opened. At the same time, the patriotic protectionists, NGOs, and government galvanized an anti-smoking movement, which gradually transformed Taiwan's culture so that smoking in public is no longer socially acceptable. A new term, “de-normalization,” was coined about the favorable effect of market opening.

 The ironic outcome of Super 301 is that while the market was forced open solely by the US, in only ten years, US market share, once leading, shrunk to a distant fifth, after Japan, UK, Germany and domestic producers. The trade imbalance was little affected by the opening of the cigarette market.

Dr. Wen's colloquium continues the colloquium series on tobacco control in East Asia, sponsored by the Asia Health Policy Program at the Shorenstein Asia-Pacific Research Center, in coordination with FSI’s Global Tobacco Prevention Research Initiative.

Iqbal Z. Quadir is the founder and director of the Legatum Center for Development and Entrepreneurship at the Massachusetts Institute of Technology (MIT), which promotes bottom-up entrepreneurship in developing countries. In the 1990s, Quadir founded GrameenPhone, which provides effective telephone access throughout Bangladesh.

Quadir is an accomplished entrepreneur who writes about the critical roles of entrepreneurship and innovations in improving the economic and political conditions in low-income countries. Quadir is often credited as having been the earliest observer of the potential for mobile phones to transform low-income countries. His work has been recognized by leaders and organizations worldwide, as a new and successful approach to sustainable poverty alleviation.

For four years, Quadir taught at the John F. Kennedy School of Government at Harvard University, focusing on the impact of technologies in the politics and economics of developing countries. In 2005, he moved to MIT. His particular research interest is in the democratizing effects of technologies in developing countries.

Earlier in his career, Quadir served as a vice president of Atrium Capital Corp., an associate of Security Pacific Merchant Bank, both in New York, and a consultant to the World Bank in Washington DC. He received an MBA and an MA from the Wharton School, University of Pennsylvania, and a BS with honors from Swarthmore College.
