Dr. Songs talk will focus on the question concerning interpretation and possible application of Article 121 of the 1982 United Nations Convention on the Law of the Sea (UNCLOS), in particular its third paragraph, to the selected disputed offshore islands or rocks that are situated in the Sea of Japan, the East China Sea, and the South China Sea. A number of recent developments occurred in the East Asian waters that are relevant to or have the potential to give rise to the problem of interpretation and application of the said article will first be cited. Then, a brief summary of the development of the "Regime of Islands" at UNCLOS III will be given, focusing in particular on those proposals made by the participating delegations to amend or delete entirely Article 121(3) of UNCLOS. The views of the law of the sea experts on interpretation and application of Article 121(3) will be examined. Several selected examples of state practices with regard to the application or interpretation of Article 121(3) will then be provided. This is to be followed by discussing the interpretation and possible application of Article 121(3) to the selected disputed offshore islands that are situated in the East Asian waters. Finally, several suggestions for possible amendment to Article 121 or policy measures to help deal with the confusion found in Article 121(3) will be offered.

Yann-huei Song received his undergraduate degree from National Chengchi University, Taipei, Taiwan, a Master's degree in Political Science from Indiana State University, Indiana, USA, a LL.M. degree from the University of California School of Law (Boalt Hall), Berkeley, California, USA, a doctoral degree in International Relations from Kent State University, Kent, Ohio, USA, and a JSD degree from the University of California School of Law (Boalt Hall), Berkeley.

Following graduation from Kent State University, Dr. Song taught at Department of Political Science, Indiana State University as Assistant Professor in 1988. He then returned to his country and taught as an Associate Professor at Institute of Maritime Law, National Taiwan Ocean University, Keelung, Taiwan in 1990. Currently, Dr. Song is a research fellow at the Institute of European and American Studies, Academia Sinica, Nankang, Taipei, Taiwan, and distinguished professor of the Graduate Institute of International Politics at National Ching Hsing University (NCHU), Taichung, Taiwan. He is also dean of the Office of International Affaris at NCHU.

Dr. Song's research interests are in the fields of International Law of the Sea, International Fisheries Law, International Environmental Law, National Ocean Policy Study, Naval Arms Control and Maritime Security. He has published articles in journals such as Political Geography Quarterly, Asian Survey, Marine Policy, Chinese Yearbook of International Law and Affairs, Issues and Studies, The American Asian Review, Ocean Development and International Law, EurAmerica, Ecology Law Review, the International Journal of Coastal and Marine Law, The Indonesian Quarterly and others.

A well-known puzzle in the study of Asian democratization is the inverse relationship between the level of democracy and the support for the "D" word. According to the latest Asian Barometer survey, Thailand, China, Vietnam, Mongolia, and Cambodia have a much higher level of overt support for democracy than those well-recognized democracies such as Japan, South Korea, and Taiwan. To unravel this puzzle, the authors develop a new regression method for the two-dimensional typological analysis including the "D" word and the liberal democratic attitude. Four ideal types of democratic orientation are defined and analyzed: Consistent Democrats (high support for democracy, high liberal democratic value), Critical Democrats (low support for democracy, high liberal democratic value), Non-Democrats (low support for democracy, low liberal democratic value), and Superficial Democrats (High support for democracy, low liberal democratic value). Different from most of the regression methods, the dependent variables in typological regression include the radius and the azimuth and therefore transform the categorical nature of the two-by-two typology into distinctive types with a continuous character. The preliminary result indicates the high support rate of the "D" word in those less democratic countries is associated with a phenomenon that the word "democracy" has lost its distinctive semantic meaning and could embrace all desirable political values, covering any variety of political systems in the world.

Professor Min-hua Huang received his Ph.D. in Political Science from University of Michigan, and his B.A. in Business Administration from National Taiwan University. He is currently teaching at the Department of Political Science, Texas A&M University. In this special seminar, he will address the above issues, leading us to reconsider democracy and democratization in Asia.

Abstract
One of the biggest themes of the 21st century is interconnection -- specifically, the interconnection of people and data.  These interconnections can change everything about how we see the world, how the world sees us, and how we work together.  Where some people might see "big brother," I see empowerment -- empowerment of groups and individuals to improve quality of life and reduce our impact on the planet. 

Megan Smith oversees teams that manage early-stage partnerships, explorations and technology licensing. She also leads the Google.org team, guiding strategy and developing new partnerships and internal projects with Google's engineering and product teams. She joined Google in 2003 and has led several of the company's acquisitions, including Keyhole (Google Earth), Where2Tech (Google Maps), and Picasa. She also co-led the company's early work with publishers for Google Book Search. Previously, Megan was the CEO and, earlier, COO of PlanetOut, the leading gay, lesbian, bisexual and transgender online community. Under her leadership, PlanetOut grew tenfold in reach and revenue. Prior to that, Megan was at General Magic for six years working on handheld communications products and partnerships. She also worked in multimedia at Apple Japan in Tokyo.

Over the years, Megan has contributed to a wide range of engineering projects, such as designing an award-winning bicycle lock; working on a space station construction research project that eventually flew on the U.S. space shuttle; and running a field-research study on solar cookstoves in South America. She was also a member of the MIT-Solectria student team that designed, built, and raced a solar car in the first cross-continental solar car race, covering 2000 miles of the Australian outback. She was selected as one of the 100 World Economic Forum technology pioneers for 2001 and 2002.

Megan holds a bachelor's degree and a master's degree in mechanical engineering from MIT, where she now serves on the board. She completed her master's thesis work at the MIT Media Lab.

Summary of the Seminar
Megan Smith, Vice President, New Business Development and General Manager, Google.org., argued that greater interconnectedness achieved by information technology is a major liberating force in the world. Whether it is aiding the coordination of protests or increasing transparency of governments, the exchange of information has huge benefits. This is not a new phenomenon. In places where people have been able to exchange information easily, social progress has followed. Megan cited the example of Seneca Falls, New York where the canal system allowed for extensive communication; it became significant in both the women's rights and abolition movements.

While a large proportion of the world is benefiting from greater interconnectedness, Africa still lacks the infrastructure to take full advantage. Submarine fiber optic cables are necessary for quick and cheap internet cables and many African countries, particularly in the east, are not connected to these, relying instead on satellites. This is likely to change over the next few years, bringing great potential for further development.

The mission of Google.org is to use technology to drive solutions to global challenges such as climate change, pandemic disease and poverty. The organization was set up as part of a commitment to devote approximately one percent of Google's equity plus one percent of annual profits to philanthropy, along with employee time.  Google.org now places its strategic focus on those projects that can leverage the resources of Google staff, particularly its engineers.

Current projects that harness the power of information include:

  • Google Flu Trends: This uses aggregated Google search data to estimate flu activity up to two weeks earlier than traditional methods. This system has almost 90% accuracy in real time flu prediction and is therefore an extremely useful tool for health delivery agencies. It is now being used in 30 countries. Google is also starting to work in Cambodia to collect data around SARS.
  • Google Power Meter provides a system for consumers to understand their in-home energy use and to take steps to reducing this. The Meter receives information from utility smart meters and in-home energy management devices and visualizes this information on iGoogle (a personalized Google homepage).The premise underlying this project is that greater information is going to be crucial to tackling climate change and consumers ought to be able to be empowered to make informed decisions about their energy use.
  • Disaster relief: In response to the Haitian earthquake, a team of engineers worked with the U.S. Department of State to create an online People Finder gadget so that people can submit information about missing persons and to search the database. Google Earth satellite images have also been used to document the extent of damage.

In the four years since a State Council think tank, the Development Research Center, bluntly declared the failure of three decades of healthcare reform, China has placed a high political priority on designing, building and financing a modern, equitable health delivery system that serves every last one of its 1.3 billion people. As publisher of practice-building trade magazines for medical specialists in China and India, Jeffrey Parker has developed unique and valuable perspectives on what's wrong with China's healthcare system -- and how Indian practitioners are able to deliver results despite a per-capita GDP that is roughly half of China's. Through an unprecedented China-India training exchange, Mr. Parker has begun testing whether Indian models of self-financed grassroots medical startup practices can help doctors shake free of China’s Stalinist paralysis without having to wait for sweeping programmatic reforms that are always on the horizon, but seem never to come. What's more, would such grassroots empowerment models not create unprecedented opportunities for participation by international investors who up to now have been largely marginalized in China's healthcare development?

In this lunchtime colloquium, Mr. Parker reviews his experiences in China and India over the past six years and looks at several exciting recent developments in China. These include:

  • An ambitious rural reimbursement scheme that already has begun to complete a nationwide healthcare safety net. The program is creating a vast pool of funds to finance rural medical services, but how will Beijing populate the countryside with sustainable grassroots practices?
  • The first domestic healthcare IPO, by which Aier Ophthalmology raised some $50 million as one of 28 debut listings in the Shenzhen's new "ChiNext" Growth Enterprise Market. New wind in the sails of healthcare privatization?
  • Licensing reforms that have begun delinking doctors' certification from their "work unit" hospitals under trials in Beijing and Yunnan, removing a vexing obstacle to hands-on surgical training of young practitioners. Will the breaking of senior doctors' "skills monopoly" create opportunities for private-sector training programs that will shake up China's Soviet-style residency programs?

Jeffrey Parker has lived in Greater China since 1990, first as a journalist and since 2003 as a publisher. His transition from chronicler of China's historic rise to active proponent of its economic development gives him a unique perspective on the opportunities still opening up in China -- and the challenges facing anyone keen to participate. With a twin B.A. in Asian Studies and Geography from U.C. Santa Barbara and Masters training in Journalism from Columbia University, Parker trimmed his sails for a China career from an early age. After early editorial jobs in New York and Washington, D.C., he was dispatched to Beijing by United Press International as senior correspondent in 1990. During the next 10 years with UPI and then Reuters, he covered a wide range of political, economic and social stories from postings in Hong Kong, Taiwan and the Peoples Republic. In his final two years at Reuters, Parker got his first taste of media development, launching local-language multimedia news and video feeds in China, Japan, Korea, India and Southeast Asia. Since 2003, Parker has built up a family of world-class doctors' magazines serving more than 50,000 specialists in China and India from the Shanghai base of ILX Media Group, where he is editorial director, chief operating officer, a corporate director and investor. Among his objectives is to help foster a badly needed transformation of medical practice across China by inspiring grassroots doctors to deliver high-quality, cost-effective services in rural and less-developed communities left behind by government health care.

Despite its frequent military coups, Thai democracy was practically a textbook case of successful transition during the 1980s and 1990s. A so-called "semi-democracy" during 1980-88 gave way to a fully elected civilian leadership whose corrupt government laid the conditions for a putsch in February 1991. As the coup makers institutionalized their power through the political party and electoral systems, a popular uprising put the military back in the barracks in May 1992. Following an organic five-year constitution-drafting process, the promulgation of the reform-driven 1997 Constitution appeared to cross the threshold between transition and consolidation. But the rise of Thaksin Shinawatra and his Thai Rak Thai party changed all that. The Thaksin regime was paradoxically corrupt and abusive of power on the one hand but delivered the goods from its populist platform through policy innovation on the other. Thaksin triumphed at the polls in 2001 and again, by a landslide, in 2005. In the same year, a Bangkok-based "yellow-shirt" movement campaigned against his graft and abuse, laying the groundwork for Thailand's latest putsch in September 2006. Thai politics has been murky and topsy-turvy since. Thaksin's opponents from the military, palace, Bangkok's middle class, royalist political parties, swathes of civil society, and the yellow-shirted People's Alliance for Democracy are now in charge, fronted by Prime Minister Abhisit Vejjajiva and his Democrat Party-led coalition government. Yet this anti-Thaksin coalition is unable to put the lid on the pro-Thaksin "red shirts" as the remarkable reign of King Bhumibol Adulyadej enters its twilight. Thai democracy and monarchy are increasingly enmeshed. Its road ahead towards a workable constitutional monarchy that is consistent with democratic development will have much to say about the democratization in developing countries. It is a crucial case that could build or sap the momentum of democratization and democracy promotion elsewhere.

Dr. Thitinan Pongsudhirak is Director of the Institute of Security and International Studies (ISIS) and Associate Professor of International Political Economy at the Faculty of Political Science, Chulalongkorn University. He has authored a host of articles, books and book chapters on Thailand's politics, political economy, foreign policy, media and ASEAN and East Asian security and economic cooperation. He is frequently quoted and his op-eds have regularly appeared in international and local media. Dr. Thitinan has worked for The BBC World Service, The Economist Intelligence Unit (EIU), Independent Economic Analysis (IDEA) and consulting and research projects related to Thailand's macro-economy and politics. He received his B.A. from the University of California at Santa Barbara, M.A. from the Johns Hopkins School of Advanced International Studies, and Ph.D. from the London School of Economics where he won the United Kingdom's Lord Bryce Prize for Best Dissertation in Comparative and International Politics. Dr. Thitinan has lectured at a host of universities in Thailand and abroad, and is currently a visiting scholar with the FSI-Humanities Center and Center on Democracy, Development and the Rule of Law.

FrontlineSMS:Medic is a Palo Alto based tech nonprofit startup that began in early 2009 with several Stanford undergraduates and graduate students at the helm. The concept behind the group's software suite is simple: free intuitive mobile phone and computer applications built upon free and open source packages, such as OpenMRS and FrontlineSMS, to allow clinics and hospitals in the developing world to use mobile phones for healthcare services in resource poor settings. Their work has already broken rapidly out of their first pilot site in Malawi and now 2.2 million patients are being covered by their software in Uganda, Tanzania, Cameroon, Kenya, Burundi, Guatemala, Honduras, India and Bangladesh. Their service partners include Partners in Health, Clinton HIV/AIDS Initiative, and Village Health Works.

Lucky Gunasekara is currently a student in Stanford University's School of Medicine studying applications of information technology in global health. He graduated from Cornell University in 2006, with Distinction in All Subjects, holding a B.A. in Neurobiology and Behavior, and a minor in East Asian Studies. From 2006 to 2008, he lived in Japan, studying public health and foreign aid as a Fulbright Scholar and working in corporate Japan. He currently serves as the Managing Director of FrontlineSMS:Medic, which he co-founded with partners, Josh Nesbit, Isaac Holeman, and Nadim Mahmud in 2009.


 

Tom Wiltzius is a undergraduate in Stanford's Computer Science program studying systems. Tom's interest in ICT for development began with work in wireless mesh networking as a means of rapidly and cheaply deploying data infrastructure in unwired areas.  Projects with the Urbana-Champaign Wireless Network, South Africa's Meraka Institute, and the Stanford Information Networks Group all contributed to an understanding of mesh networking centered around applications for the developing world. Tom is currently working on a cost-sensitive, intuitive data collection tool designed for community healthcare workers in semi-connected rural environments as his senior thesis in conjunction with the FrontlineSMS:Medic project.
