José Zalaquett is a Chilean lawyer and legal scholar known for his work defending human rights in Chile during the regime of General Pinochet. During Chile's transition to democracy, he served on the National Truth and Reconciliation Commission where he investigated and prosecuted human rights violations committed by the military regime. He has served as President of the Inter-American Commission on Human Rights and as the head of the International Executive Committee of Amnesty International. He currently co-directs the Human Rights Centre at the University of Chile, serves on the board of the International Centre for Transitional Justice, and is a member of the International Commission of Jurists. He has been awarded UNESCO's Prize for Human Rights Education and Chile's National Prize for Humanities and Social Sciences.

Professor Karl has published widely on comparative politics and international relations, with special emphasis on the politics of oil-exporting countries, transitions to democracy, problems of inequality, the global politics of human rights, and the resolution of civil wars. Her works on oil, human rights and democracy include The Paradox of Plenty: Oil Booms and Petro-States (University of California Press, 1998), honored as one of the two best books on Latin America by the Latin American Studies Association, the Bottom of the Barrel: Africa's Oil Boom and the Poor (2004 with Ian Gary), the forthcoming New and Old Oil Wars (with Mary Kaldor and Yahia Said), and the forthcoming Overcoming the Resource Curse (with Joseph Stiglitz, Jeffrey Sachs et al). She has also co-authored Limits of Competition (MIT Press, 1996), winner of the Twelve Stars Environmental Prize from the European Community. Karl has published extensively on comparative democratization, ending civil wars in Central America, and political economy. She has conducted field research throughout Latin America, West Africa and Eastern Europe. Her work has been translated into 15 languages.

Karl has a strong interest in U.S. foreign policy and has prepared expert testimony for the U.S. Congress, the Supreme Court, and the United Nations. She served as an advisor to chief U.N. peace negotiators in El Salvador and Guatemala and monitored elections for the United Nations. She accompanied numerous congressional delegations to Central America, lectured frequently before officials of the Department of State, Defense, and the Agency for International Development, and served as an adviser to the Chairman of the House Sub-Committee on Western Hemisphere Affairs of the United States Congress. Karl appears frequently in national and local media. Her most recent opinion piece was published in 25 countries.

Karl has been an expert witness in major human rights and war crimes trials in the United States that have set important legal precedents, most notably the first jury verdict in U.S. history against military commanders for murder and torture under the doctrine of command responsibility and the first jury verdict in U.S. history finding commanders responsible for "crimes against humanity" under the doctrine of command responsibility. In January 2006, her testimony formed the basis for a landmark victory for human rights on the statute of limitations issue. Her testimonies regarding political asylum have been presented to the U.S. Supreme Court and U.S. Circuit courts. She has written over 250 affidavits for political asylum, and she has prepared testimony for the U.S. Attorney General on the extension of temporary protected status for Salvadorans in the United States and the conditions of unaccompanied minors in U.S. custody. As a result of her human rights work, she received the Doctor of Humane Letters, honoris causa from the University of San Francisco in 2005.

Professor Karl has been recognized for "exceptional teaching throughout her career," resulting in her appointment as the William R. and Gretchen Kimball University Fellowship. She has also won the Dean's Award for Excellence in Teaching (1989), the Allan V. Cox Medal for Faculty Excellence Fostering Undergraduate Research (1994), and the Walter J. Gores Award for Excellence in Graduate and Undergraduate Teaching (1997), the University's highest academic prize. Karl served as director of Stanford's Center for Latin American Studies from 1990-2001, was praised by the president of Stanford for elevating the Center for Latin American Studies to "unprecedented levels of intelligent, dynamic, cross-disciplinary activity and public service in literature, arts, social sciences, and professions." In 1997 she was awarded the Rio Branco Prize by the President of Brazil, Fernando Henrique Cardoso, in recognition for her service in fostering academic relations between the United States and Latin America.

Access to life-saving pharmaceuticals and medical treatments is a nagging problem for millions of Latin Americans. In several countries of the region, judicial actions for the protection of basic rights have proved to be instrumental for gaining access to such goods. Brazil and Colombia are, allegedly, the two Latin American countries with the largest number of right to health cases. Everaldo Lamprea suggests that dismantling right to health litigation in order to reduce public costs--as was recently proposed by the Colombian government-- would be a catastrophic event for many Colombians, trapped in a heavily privatized and deregulated health system where many life-saving pharmaceuticals and medical treatments are out of the reach of most pockets. Lamprea will suggest that a more reasonable governmental reaction should include an analysis of the role played in the current health-sector crisis by global actors such as International Financial Institutions and BigPharma companies

Nuhu Ribadu is a visiting fellow at the Center for Global Development. His work at the Center, which began in April 2009, is to draw lessons from his experience for combating corruption worldwide and to provide fresh thinking on the role of international institutions in this fight. Before joining CGD, Nuhu was head of Nigeria's Economic and Financial Crimes Commission (EFCC) from 2003 to 2007. He served on several economic and anti-corruption commissions and was a key member of Nigeria's economic management team that drove wide-ranging public sector reforms. Nuhu was awarded with the World Bank's Jit Gill Memorial Award for Outstanding Public Service in recognition of his efforts. Prior to leading the EFCC, Nuhu spent 18 years in the Nigerian police force. A lawyer by training, he received his Bachelors and Masters in Law from Ahmadu Bello University in Nigeria. Nuhu is also a Senior Fellow at St. Anthony's College at Oxford University in the UK.

On March 30, 2010, Prof. Samer Shehata from Georgetown University gave a research seminar for the Program on Arab Reform and Democracy at CDDRL titled The Regional Dimensions of Authoritarianism in the Arab World.  Prof. Shehata’s talk was in response to the research puzzle, as he called it, of the persistence of authoritarian politics at the regional level in the Arab world. He argued that the subject that has received most attention in political science is the question of authoritarianism and absence of democracy. The question of why there are no democracies has offered a number of possible reasons including: the qualities and consequences of oil and rentier politics; absent or weak civil societies in the Arab world; social class-based explanations; the issue of political liberalization instead of democratization; external factors such as US support for authoritarian regimes, which he argued has not decreased since the end of the Cold War; regional conflicts like Palestine/Israel and the Gulf wars; institutions of authoritarianism including how elections, parliaments and single parties work; Islamist politics creating deep divisions among opposition groups; and patronage, clientelism and the (absence of) social contract.

Prof. Shehata then proceeded to say that there has been some positive development in the approach to democracy in the Arab world, but that there remains insufficient attention to the regional dimensions of authoritarianism. He argued that the Arab world is authoritarian not just on the state level, but also on the regional level. As International Relations specialists have spoken about the existence of an Arab regional system, the institutional dimension of this system, such as the Arab League, needs to be studied.

He stated that there are three mechanisms of the reproduction of authoritarianism on the regional level: authoritarian learning, authoritarian cooperation, and regional organizations. Cases of authoritarian learning take both direct and indirect forms where certain regimes “learn” from one another. He gave the example of constitutional amendments that allow elections but that give the illusion of competition, where electoral outcomes are similar. In Tunisia, for example, Ben Ali “learned” from the Algerian experience by not allowing Islamists an electoral opening.

Authoritarian cooperation, he went to argue, occurs mainly regarding security matters. He gave the example of certain activists not being to allowed certain countries in the Arab world (like the Tunisian Moncif Marzouki, who was not allowed into Lebanon). Such “cooperation” widens the scope of authoritarianism beyond the borders of individual states.

Prof. Shehata’s ended with a discussion of the third mechanism, regional organizations. He talked about institutionalized cooperation within the Arab League and the GCC, calling the Arab League a “club for authoritarian regimes” that is not committed to democracy. An example of this in action is the Arab League accords on security and anti-terrorism which have ended up extending authoritarian rules across the Arab world. Another example is the Arab media charter that was put in place in February 2008, and which limits internet and media freedom. Prof. Shehata acknowledged that further research needs to be done on those three mechanisms and the floor was then opened to questions from the audience.

This 2009-10 interdisciplinary research workshop examines the trajectory of human rights discourse and institutions in Africa by means of regional and international comparisons. Africa is the third, and most recent, region to establish a regional human rights court, the African Court of Human and Peoples' Rights (ACPHR). At this critical juncture in African human rights, there is an urgent need for deeper understandings and applications of the law of human rights.

This workshop will be of interest and benefit to faculty and graduate students conducting research in the following areas: African studies; human rights; law; anthropology; cultural studies; history; political science and international relations; philosophy; and sociology.

The workshop, coordinated by Helen Stacy (Law School, FSI), met once during Fall quarter and will meet three times during the Winter and Spring quarters of the 2009-2010 academic year.

Our first meeting of Spring quarter features Professor Harri Englund, Department of Social Anthropology at University of Cambridge and author of many articles and books including Prisoners of Freedom: Human rights and the African Poor (Berkeley: University of California Press, 2006).

Focus

In 2008, for the first time a majority of the world's population lived in cities. Rapidly rising standards of living and migration are contributing to an unprecedented worldwide surge in urbanization--in China alone, if trends continue, by 2025 more than 220 cities will each have more than one million inhabitants. The explosive growth of cities around the Pacific has widespread implications for energy use and has led to the demand for cities to become both smart and green.

But while billions of dollars of investments are pouring into urban energy solutions, and around the Pacific "low-carbon cities" and "eco-cities" are moving center stage, there are enormous challenges (and opportunities) facing the effective application of information technologies (IT), other innovative technologies and industrial growth.

The intersection of IT and environmental sustainability on the urban scale will require a complex integration of expertise, tools, and know-how from multiple disciplines--from building design and real estate development, to mobility and water systems, IT hardware and software, and energy providers. Although innovations in strategies and implementation are evolving quickly in pockets of excellence around the globe, early results have been highly uneven. Frameworks for understanding and analysis are still fragmented, innovative design and implementation rapidly changing, and best practices have yet to be defined.

Purpose
Led by SPRIE at Stanford University, this conference aims to gather an elite group of experts, decision makers, and thought leaders from across disciplines and geographical boundaries to focus on smart green cities around the Pacific. Participants will:

  • Pursue a deeper understanding of the complex interactions among the key drivers that impact the extent that cities are green and smart
  • Focus on core challenges of capitalizing on opportunities and overcoming obstacles--technological, economic, behavioral or political
  • Explore what innovations in strategy or practice are leading to positive outcomes, including human livability, financial viability, economic vitality, and environmental sustainability
  • Discuss implications for the evolution of markets and development of industries 
  • Lay the groundwork for future actions, such as industry strategies, research agendas, and policy recommendations

Participants
"Smart Green Cities" will invite a select group of government, business, and academic leaders from the United States and Asia for two days of expert presentations and fruitful discussion at Stanford University. The summit will enable participants to better lead to improved strategy, action, and outcomes for building the next generation of smart green cities.

The Association of Southeast Asian Nations (ASEAN) is Asia’s most resilient regional organization.  Its ambitious new charter aims to foster, in a dynamic but disparate region, a triply integrated region comprising a Political and Security Community, an Economic Community, and a Socio-Cultural Community.  The charter’s debut under Thailand’s 2008-09 chairmanship of the Association was badly marred, however, by political strife among Thai factions, clashes on the Thai-Cambodian border, and border-crossing risks of a non-military kind.  How have these developments affected ASEAN’s regional performance and aspirations?  Are its recent troubles transitional or endemic?  Do they imply a need for the Association to reconsider its modus operandi, lest it lose its role as the chief architect of East Asian regionalism?

Dr Thitinan Pongsudhirak is director of the Institute of Security and International Studies and an associate professor of international political economy at Chulalongkorn University in Bangkok.  He is a prolific author, having written many op eds, articles, chapters, and books on Thailand’s politics, political economy, foreign policy, and media, and on ASEAN and East Asian security and economic cooperation.  He has worked for The Nation newspaper (Bangkok), The Economist Intelligence Unit, and Independent Economic Analysis (London).  His degrees are from the London School of Economics (PhD), Johns Hopkins University’s School of Advanced International Studies (MA), and the University of California (BA).  His doctoral study of the 1997 Thai economic crisis won the United Kingdom’s Lord Bryce Prize for Best Dissertation in Comparative and International Politics—currently the only work by an Asian scholar to have been so honored.

Professor Jenny S. Martinez is a leading expert on international courts and tribunals, international human rights, and the laws of war. Her scholarship focuses on the role of courts and tribunals in advancing human rights, ranging from her work on the all-but-forgotten 19th-century international tribunals involved in the suppression of the trans-Atlantic slave trade through her work on contemporary institutions like the International Criminal Court and the role of courts in policing human rights abuses in the "war on terror." An experienced litigator, she argued the 2004 case of Rumsfeld v. Padilla before the U.S. Supreme Court, seeking to clarify the constitutional protections available to post-9/11 "enemy combatants" who are U.S. citizens. Professor Martinez was named to the National Law Journal's list of "Top 40 Lawyers Under 40" and the American Lawyer's "Young Litigators Fab Fifty." She serves on the board of directors for the Open Society Justice Initiative and has served as a consultant on international human rights issues for both Human Rights First and the International Center for Transitional Justice.

Before joining the Stanford faculty in 2003, Professor Martinez was a senior research fellow at Yale University and an attorney at Jenner & Block. She clerked for Justice Stephen Breyer (BA '59) of the U.S. Supreme Court and Judge Guido Calabresi of the U.S. Court of Appeals for the Second Circuit; she was an associate legal officer for Judge Patricia Wald of the United Nations International Criminal Tribunal for the former Yugoslavia.

Firoze Manji is founding Executive Director of Fahamu - Networks for Social Justice, a pan African organization with offices in Kenya, Senegal, South Africa and the UK.

Fahamu exists to support the development and growth of a powerful social justice movement in Africa. There are three core areas of activity:

Training: Fahamu aims to strengthen human rights organizations by providing training programs that include sufficient pre workshop preparation and post workshop follow-up to ensure substantive learning. Fahamu has created CD-ROM based training packages covering subjects from advocacy to financial management to gender violence and conflict.

News & Media: Pambazuka News is a weekly electronic newsletter providing commentary and analysis on issues of social justice across Africa, published in English, French and Portuguese. There are 26,000 subscribers and half a million unique visitors to the site. Content is also published on allafrica.com and it is widely used by mainstream media. Pambazuka was one of the first African organizations to use podcasts and videocasts.

Advocacy: Fahamu was heavily involved in efforts to persuade countries to sign up to the African Union's Rights of Women in Africa Protocol. The organization attracted a great deal of attention for its strategy of getting people to sign a petition via cell phones. Within 18 months it had persuaded the necessary 15 countries to ratify the Protocol.

Firoze shared a number of his insights from his experience using ICTs in these areas:

There remain real barriers to use of ICTs in Africa: Middle class Africans often have more than one cell phone each; penetration figures can therefore be misleading. The cost associated with text and especially voice services is prohibitive for many. While email is cheap, web surfing is expensive and due to low bandwidth, painfully slow. 

Paper formats are in some instances still the most useful: Feedback from students on Fahamu courses has shown consistent demand for paper resources. Students rarely have their own home computer or laptop and they may travel often; internet cafes can be unsafe environments for women alone. For these reasons, Fahamu continues to produce print resources. It also recently launched Pambazuka Press to promote African writers.  Books will be sold at cost to distributors in Africa and at commercial rates elsewhere.

Technology tools are a complement to, not substitute for real engagement: Analysis of the Rights of Women Protocol petition showed that less than 10% of signatures had come via cell phones. It was the political legwork of going through the protocol in person with each individual that made the real difference to the outcome. This confirms Firoze's view that tools such as cell phones cannot create social change where there is no existing real-world network for them to tap into. We need to be wary of fetishizing technology tools, attributing to them powers they simply cannot have.

Technology, Froze argues, tends to reflect and amplify existing social relations. So while ICTs can enable people to voice their own experience in a way that was not available to them before, they can just as easily serve to shore up existing power structures.

Discourse on American public diplomacy has been traditionally focused on use of the broadcast media by the US government, such as Voice of America, to reach out to audiences in the Middle East and other regions. For example, much has been written about initiatives such as Radio Sawa and Al-Hurra television, and their struggles to gain credibility among Arab audiences.
