In this Article, we describe an emerging arena of global administration. We claim that this arena, not bounded by a state, raises accountability problems of a kind different from those addressed by conventional administrative law. And we argue that measures designed to address these problems will have potentially large implications for democratic theory and practice. Our argument starts from the premise—stated here without nuance—that something new is happening politically beyond the borders of individual states and irreducible to their voluntary interactions. To distinguish these developments from what is commonly called “international law and politics,” we use the term “global politics.” The emergence of global politics is marked by a proliferation of political settings beyond domestic boundaries. This proliferation expands the range of relevant political actors, while shifting our understanding of political units and of relations among them: the emergence of human rights as limits on Westphalian sovereignty was a first step in this shift, but not the last.

The authors examine the global expansion of higher educational enrollments over the 20th century. Rates of growth accelerated in virtually all countries after 1960. Drawing upon institutional arguments, we discuss the nature of this transformation and the historical trends that brought it about. A changed model of society came into place globally - one in which schooled knowledge and personnel came to be seen as appropriate for a wide variety of social positions, and where many more young people could be viewed as appropriate candidates for higher education. An older vision of education as contributing to a closed society and occupational system - with associated fears of "overeducation" - was replaced by an open-system picture of education as useful "human capital" for unlimited progress. This shift involves several global changes, including:

  1. increasing global emphasis on democracy and human rights;
  2. the advent of modern national development planning; and
  3. the expansion of science as a broad authority in social life. The authors these arguments and several others using pooled panel regression analyses over the period 1900-2000.

They find support for the institutional argument, as well as for several more specific arguments regarding national variation: enrollments are higher in countries better organizationally linked-in to world society, where secondary enrollments are high, where economic development is higher, and where state control over education is low. But global trends dominate the analysis, such that many developing countries now have higher enrollment rates than European countries did only a few decades ago. The article discusses implications of a world in which all countries have large elite sectors schooled in institutions that have a great deal of cultural commonality.

His view is that war is a human catastrophe, not an exciting, noble adventure. Because it is a catastrophe, you should only fight when you must. You should only fight in a war of necessity, never in a war of choice. You fight when there is a great and imminent evil and no way of preventing it without fighting.

Zachary Kaufman is currently a Juris Doctorate (JD) candidate at Yale Law School, where he is Managing Editor of the Yale Human Rights & Development Law Journal, Articles Editor of the Yale Journal of International Law, Policy Editor of the Yale Law & Policy Review, and co-founder and co-president of Yale Law Social Entrepreneurs. At the same time, Mr. Kaufman is completing his D.Phil (PhD) degree in International Relations at the University of Oxford, where he was a Marshall Scholar from 2002-05.He was a CDDRL Pre-Doctoral Fellow (2005-2006).

Kaufman's dissertation is an analysis of the U.S. government policy objectives in supporting the establishment of four war crimes tribunals: the International Military Tribunal (the Nuremberg Tribunal), the International Military Tribunal for the Far East (the Tokyo Tribunal), the United Nations International Criminal Tribunal for the former Yugoslavia, and the United Nations International Criminal Tribunal for Rwanda.

Kaufman's professional experience has focused on the investigation, apprehension, and prosecution of suspected perpetrators of atrocities, including genocide, war crimes, crimes against humanity, and terrorism. He has served at the U.S. Department of State, the U.S. Department of Justice, the UN International Criminal Tribunal for the former Yugoslavia, and the UN International Criminal Tribunal for Rwanda. Kaufman also was the first American to serve at the International Criminal Court, where he was policy clerk to the first Chief Prosecutor.

Kaufman is the founder, president, and chairman of the Board of Directors of the American Friends of the Kigali Public Library; co-founder and Executive Director of Marshall Scholars for the Kigali Public Library; and an Honorary Member of the Rotary Club of Kigali-Virunga, Rwanda. Together, these three non-profit organizations are fundraising and collecting books for, raising public awareness about, and building Rwanda's first public library, the Kigali Public Library. Kaufman is also a Board Member and Senior Fellow of Humanity in Action, which, in order to engage student leaders in the study and work of human rights, sponsors an integrated set of education programs and internships for university students in Europe and the United States.

In 2004, Kaufman received his M.Phil (Master's) degree in International Relations from the University of Oxford. In 2000, Kaufman received his B.A. (Bachelor's) degree with honors in Political Science from Yale University.

PhD

David Backer is a post-doctoral Fellow (Ph.D. Michigan) at CDDRL. His dissertation project was an evaluation of the impact of participation by victims in South Africa's Truth and Reconciliation Commission (TRC). He is extending this research by comparing attitudes of victims and the general public, as well as conducting a longitudinal study of victims' attitudes about reparations. In addition, he is undertaking a parallel study of victims' responses to the truth commission processes in Ghana, Nigeria and Sierra Leone.

In another project, Backer looks at modes of transitional justice around the world and their effects on political development including regime stability, human rights practices, inter-group conflict, political violence and rates of violent crime.

Coit D. Blacker, director of the Freeman Spogli Institute for International Studies at Stanford University, recently named Professor Michael McFaul as the new director of the Center on Democracy, Development, and the Rule of Law (CDDRL). McFaul, a reknowned specialist on the former Soviet Union, is currently associate professor of political science at Stanford as well as the Peter and Helen Bing Senior Fellow at the Hoover Institution. He is also an alumnus of Stanford University.

In appointing McFaul to lead CDDRL, Blacker expressed his confidence that the center will continue to establish itself as one of the leading research units in the United States devoted to exploring the interactions between the establishment of democracies, promoting development, and the rule of law. The center's previous director was Stephen D. Krasner, who took Ppublic service leave from Stanford in the winter of 2004 to serve as the director for policy planning at the U.S. Department of State.

Before joining the Stanford faculty in 1995, McFaul worked for two years as a senior associate for the Carnegie Endowment for International Peace in residence at the Moscow Carnegie Center. McFaul is also a research associate at the Center for International Security and Arms Control (CISAC) and a senior adviser to the National Democratic Institute. He serves on the board of directors of the Eurasia Foundation, Firebird Fund, International Forum for Democratic Studies of the National Endowment for Democracy, Institute of Social and Political Studies, Center for Civil Society International, and Institute for Corporate Governance and Law; the steering committee for the Europe and Eurasia division of Human Rights Watch; and the editorial boards of Current History, Journal of Democracy, Demokratizatsiya, and Perspectives on European Politics and Society. He has served as a consultant for numerous companies and government agencies.

McFaul's current research interests include democratization in the post-communist world and Iran, U.S.-Russian relations, and American efforts at promoting democracy abroad. With Abbas Milani and Larry Diamond, he codirects the Hoover project on Iran.

McFaul is the author and editor of several monographs including one with Kathryn Stoner-Weiss, After the Collapse of Communism: Comparative Lessons of Transitions (Cambridge University Press, 2004). McFaul also comments on current Russian and U.S.-Russian affairs, including articles in the Chicago Tribune, Los Angeles Times, Moscow Times, New Republic, New York Times, San Jose Mercury News, Washington Post, Washington Times, and the Weekly Standard, as well as television appearances on ABC, BBC, CBS, CNN, Fox News, NBC, and PBS. During the 1995 parliamentary elections in Russia, he worked as senior consultant and commentator for CBS News. During the 1996 presidential election, 1999 parliamentary election, and 2000 presidential election in Russia, he served as a commentator and adviser for CNN. While in Moscow in 1994-95, he also coproduced and appeared in his own television program on democracy for the Russian Television Network (RTR).

McFaul was born and raised in Montana. He received his BA in international relations and Slavic languages and his MA in Slavic and East European Studies from Stanford University in 1986. He was awarded a Rhodes Scholarship to Oxford where he completed his PhD in international relations in 1991.

Since the beginning of President Chen Shui-bian's second term in 2004, there has been great controversy about plans to rewrite or revise the national constitution and what that new constitution should include. Although it is largely seen as a declaration of Taiwanese sovereignty, one important area of constitutional reform concerns human rights for the 450,000 Aboriginal people of Austronesian descent on the island and their communities.

In the summer of 2004, a series of public consultations were held at the Indigenous Peoples Council in Taipei to debate how indigenous rights should be incorporated into the new constitution. After a long process of debate in Taiwan, as well as studies of similar cases in Canada, Latin America, New Zealand and elsewhere, a series of clauses on indigenous rights were drafted and submitted for deliberation at higher levels. These included demands on such issues as return of traditional lands, regional autonomy, and increased representation in the central government.

Professor Simon will discuss the relationship between the indigenous social movement and the Taiwan Independence Movement. How do there interest merge; and where do they differ? What does aboriginality mean for the evolving Taiwanese national identity?

Scott Horton is a leading authority on international law regarding torture. He led an American Bar Association investigation into standards of treatment for detainees which was published in April 2004. He was a consultant for those representing Guantanamo Bay detainees, advising them on the legal implications of officially sanctioned torture. He contributed to the recent book, "The Torture Papers: the Road to Abu Ghraib."

An attorney and human rights defender, Scott represented Andrei Sakharov, Elena Bonner and other leaders of the human rights movement in the formerly communist world for more than twenty years. He is a member of the Council on Foreign Relations and an advisor to its Center on Preventive Action, the president of the International League for Human Rights, chair of the New York City Bar's Committee on International Law, and an adjunct professor at Columbia University Law School. He has appeared as a commentator on international law issues on BBC's Panorama, ABC's 20/20 and Nightline, the CBS Evening News, NBC Dateline, CNN's Paula Zahn Show, PBS's NOW with Bill Moyers and as a frequent guest on the Newshour with Jim Lehrer.

Sherri G. Kraham joined the Millennium Challenge Corporation (MCC) in March 2004 as its Director of Development Policy, working on a broad range of policy issues related to MCC's innovative approach to development. Ms. Kraham, a lawyer, transferred from the U.S. Department of State where she worked overseeing and implementing various U.S. Foreign Assistance including development, peacekeeping and security, humanitarian assistance, and human rights programs. She spent several years working on programs related to Iraq and prior to joining MCC, Ms. Kraham deployed to Baghdad working with the Coalition Provisional Authority as part of the first civilian team that worked on reconstruction following the war.

About the Millenium Challenge Corporation: President George W. Bush established the Millenium Challenge Account in order to link greater contributions from developed nations to greater responsibility from developing nations. The Millennium Challenge Account (MCA)is designed to concretely link assitance to performance by providing aid to those countries that rule justly, invest in their people, and encourage economic freedom. With strong bipartisan support, Congress authorized the Millennium Challenge Corporation (MCC) to administer the MCA and provided $1 billion in initial funding for FY04. President Bush's request for the MCA in FY 2005 was $2.5 billion of which Congress appropriated $1.5 billion. The President has pledged to increase funding for the MCA to $5 billion in the future.
